Sharia Measures to Prevent Divorce and Its Manifestations in Takhar Province, Afghanistan
Abstract
Islam has a complete human life system based on justice and freedom. Also, Islam has a universal law and high foundations. Therefore, this religion has allowed humans to regulate and lead their lives based on it. It is not even allowed for anyone to disobey his responsibility or violate the rights of others, or the freedoms and liberties of others, deprive the people that a woman has a high value and position in Islam. A woman can enter into or terminate a marriage. Based on the current situation in Afghanistan, it is requested that an investigation be conducted regarding Islamic Sharia measures to prevent the occurrence of divorce in Takhar Province. Therefore, by distributing research questions, we researched and analyzed the various dimensions of this issue and its relative results. The result obtained through the questionnaire distribution is that divorce is one of the exceptional issues. Still, marriage and its continuity form the basis of human life, especially husband and wife. Therefore, this (marriage) should remain permanently. Still, a series of causal factors cause divorce and its increase in society, including non-compliance with the laws and rules of Islamic Sharia, addiction to drugs, and ignorance. The negative effect of divorce is the absence of real invitations in the society. Divorce is the last solution to getting rid of a fruitless marriage. Therefore, if someone is patient, Allah will reward him, and if he does not wait and divorces, there is no problem Because God does not oblige any person beyond his ability. However, whenever the husband does the divorce, it should be done by pleasure and desire, not by pressure, reluctance, enmity, false claims and slander that the divorcee is aware of. Through this research, it became clear that Islamic Sharia has a series of tools and means, the observance of which prevents the occurrence of divorce and causes the continuation of a married couple.
