The Responsibility of the Administration for the Execution of Administrative Contracts Under the Fluctuating Economic and Political Conditions in Iraq and Egypt: A Comparative Study
Abstract
The research aims to shed light on the role of management responsibility in implementing administrative contracts in an unstable environment, explore the extent to which these contracts are affected by economic and political determinants, and compare the Iraqi and Egyptian experiences. The research relies on a descriptive, analytical, and comparative approach the study concluded that administrative contracts represent an effective means of achieving the public interest and managing it in an organized manner. They enable the administration to manage public facilities and ensure the efficient and continuous provision of essential services to the community. Iraqi law is more flexible in amending obligations affected by emergency circumstances, while Egyptian law imposes additional restrictions to ensure that this theory is not exploited to exempt from liability without a clear legal justification the study also recommends developing legal frameworks for administrative contracts to enable management to amend contracts in response to economic and political changes, ensuring the continuity of project implementation without disruption.
